Look, as a realtor I know that if you want any power in the situation you can NOT withhold rent. Dont listen to people that tell you to do that, its a dumbass move and it will fuck you in the end. The minute you do that he holds all the cards and he could evict you, ruin your credit and you may never be able to get an apartment again. If its in the contract that you are supposed to have certian bandwidth then you can take him to court but if it doesnt but one of the things they advertise is free high speed internet, then you also have standing. But I wouldnt say youre downloading torrents to the judge, or downloading anything, just say youre watching online video... or something. AND if it is in your contract send him a letter to stop limiting your bandwidth VIA REGISTERED MAIL, and if he doesnt, then HE has broken the lease and you can move out with no penalties, and you could probably sue him for "deceptive trade practices" which means you automatically get 3 times the cost of your damages... which would probably be the rent for the months that he has limited your BW. I dont like that shit either..... But the best way to handle it would probably be to learn as much as you can about the system he has there and hack it. dont cut him out completely otherwise hell know someone did something then hed fix the problem and youd have to figure a new way around it. |

Pay for it yourself- most ‘included‘ cable TV packages/broadband services that come with the price of rent are shit anyway. Pirate the move at work on their network and burn it there to a disc! NO! I am just kidding... Don‘t you have friends? If my broadband was assed out I‘d just get a buddy to snag a few torrents I wanted for me and burn them. Itâ€s not the FBI that gets you fools. Itâ€s your Internet Provider and they give you three warnings. Then after that they terminate you. Then if you get another provider and get caught you get fined. Downloading anything over a gig in a day is risky. I would keep it around 500MB a day.If you do over a gig a day it throws up a red flag and they got you. So beware how it works. If you download new movies, they send out decoys witch might be a perfect DVD rip. But it trace back to your mac address on your Internet Provides Box like Time Warner As an example. I would no all this because it happen to me now I canâ€t download shit. So i warn people be careful and download a little a day. @lboyrobot What youre landlord has done is using a program to slow down the connection. What those programs basicly do is its simulates slow TCP/IP connections. However there MAYBE i don‘t say this will work. A partial solution, there programs (download speed managers ectra) that can boost youre speed up by simple opening up multiply connection. But to tell you the truth, ask youre landlord to cut you some slack, or maybe a SMALL fee to convince him that you need some more speed. I think thats the best solution. Kevin Poulsen Email 05.26.05 Acting on detailed information provided by the motion picture industry, federal agents descended on administrators and users of a popular pirate-friendly file-sharing site Wednesday in what the government is calling the first criminal law enforcement action against BitTorrent users. FBI and Immigration and Customs Enforcement, or ICE, agents executed 10 search warrants in nine states in a strike on Elitetorrents.org, a free, members-only BitTorrent aggregator hosted in the Netherlands. On Wednesday, visitors to the site were redirected to a new government-hosted page with a stern warning about the penalties for internet piracy: "Individuals involved in the operation and use of the Elite Torrents network are under investigation for criminal copyright infringement." The crackdown was coordinated by a federal task force in San Diego, and given the punny code name "Operation D-Elite." The targets were alleged administrators of Elitetorrents.org, and a few suspected uploaders chosen for being particularly prolific in their sharing of copyright material. "We‘re talking in the tens of terabytes," said ICE supervisory agent Jim Sevel, who oversaw the raids. Another 10 suspects outside the United States remain under investigation, but were not a part of Wednesday‘s raids, said Sevel. Casual downloaders were also spared, but a Justice Department spokesman in Washington would not rule out future federal action against them. "We‘re not going to be in a position to comment on individual downloaders at this time," said spokesman Brian Sierra. "At this particular stage, the focus is the leaders, and that‘s why the search warrants were executed where they were." ICE, the largest investigative arm of the Department of Homeland Security, spearheaded the investigation because of its international scope. The raids came less than a week after the Motion Picture Association of America publicly slammed BitTorrent for accelerating the spread of a pirated copy of Revenge of the Sith. According to the government, the third Star Wars prequel was available through Elitetorrents.org more than six hours before it was first shown in theaters, and was downloaded more than 10,000 times in the next 24 hours. A Google cache of the site‘s front page taken May 19, the day the film was released, shows administrators complaining that the site was creaking under the load of the sudden influx of Star Wars fans, and requesting donations to help fund a server upgrade. Elitetorrents.org granted users varying levels of access depending on how much of their bandwidth they shared with other downloaders, with generous uploaders getting first crack at newly released content. The Justice Department wouldn‘t comment on how officials zeroed in on Elitetorrent‘s biggest players, but ICE‘s Sevel credited the MPAA, which somehow got a line on the site‘s server logs. "The MPAA provided us with information that led us to the logs and data for the servers ... the logs for the users as well as the uploads and downloads," said Sevel. The organization did not just provide a list of IP addresses of file swappers -- which is easy to get on any peer-to-peer network -- but found some of "the actual records from the server," Sevel said. Dean Garfield, the MPAA‘s vice president and director of legal affairs, acknowledged assisting in the investigation, but wouldn‘t confirm or deny the organization‘s role in obtaining the logs. "We tried to supply whatever assistance that we could," Garfield said. Asked if the group had hacked the site, he said, "I can unequivocally say that we didn‘t do anything that would constitute hacking or circumvention or anything of that sort." BitTorrent speeds internet file transfers by shifting the bandwidth burden off the publisher and distributing it among users downloading the file: Everyone downloading a file over BitTorrent is unobtrusively uploading it to other users at the same time. Wednesday‘s raids came the same day BitTorrent inventor Bram Cohen and his company, BitTorrent, launched a search engine dedicated to finding and cataloging files available for download through the peer-to-peer protocol -- an action some experts believe could expose him to legal action. But Garfield said the MPAA doesn‘t believe the protocol itself is unlawful, and isn‘t gunning for Cohen‘s search engine. "We‘re hopeful that Bram Cohen will work with us in making sure that (the search engine) doesn‘t become a tool for piracy, and will truly live up to what he has said, which is that he wants to prove that BitTorrent can be a powerful tool for distributing public-domain content," said Garfield. |

My coworker just got a nasty letter from his ISP (optonline) accusing him of copyright infringement. It turns out that his kid got caught downloading some warez from one of the trackers indexed by Torrentspy. Conclusions are simple: someone is monitoring Torrentspy network. I dont know if they do this by setting up decoys, or if they actually connect to legitimate torrents and log the IPs in the swarm. But either way, they are out there and if you are not careful you might get caught. The ISP my coworker is using seems to be doing the right thing. They notified him about the complaint, and warned him that future complaints may lead to termination of his account. It doesnt seem that they were willing to cough up his personal data so far, so he might get lucky and avoid being slapped with one of those frivolous lawsuits. The poor kid is not allowed to use BitTottent anymore. He got a stern talking to from his pop for using these new-fangled, easily trackable p2p technologies instead of leaching from Usenet the way internet Gods intended it. While largely symbolic - Comcast will not be fined, the Journal reports - it marks an important victory for campaigners seeking greater regulation of the internet. The case was brought by P2P video network Vuze and activist group Free Press.
The ruling faces an immediate challenge, since the FCC‘s decision retrospectively turns a "non-binding" aspiration into a rule. A 2005 policy statement, passed under the previous FCC chairman, made broad aspirational statements about what the net should look like. These were so vague however, that Powell‘s successor Kevin Martin recently admitted that it wasn‘t clear what the rule meant. And because this rule bypassed the mandatory public consultation process, will most likely be struck down. Click here to find out more! Nevertheless, it‘s a symbolic victory for the well-funded "Net Neutrality" campaign - and a remarkable comeback for an issue that was all but dead a year ago. Citizen and non-profit networks - who don‘t have the deep pockets necessary to lobby in DC - are likely to be disproportionately hurt. For example Brett Glass, who runs a small community wireless ISP in Laramie, Wyoming, wrote this weekend that tying the hands of the operator would make operating a wireless ISP impossible, and would harm long-term investment in US broadband. Business models which depend on an "ultra-fast lane", for example for delivering real-time video monitoring or movies, are now vulnerable to activists‘ challenge, as they clearly "violate neutrality rules". "A ruling against Comcast would harm every broadband provider, but especially the smaller ones and the ones that are breaking new ground by covering previously unserved areas," wrote Glass. At stake is the ability of an ISP to manage traffic on its network. Neutrality advocates want to regulate the ability of ISPs to prioritize traffic by application type because it violates "Free Speech" - even if the application in question is a worm, or (more commonly) network performance for all users is hampered by a few bandwidth hogs. (Vuze, the FCC‘s petitioner, operates no network of its own.) "Such traffic-specific profiling and flow throttling set[s] the stage for ISPs to pick winners and losers on the ‘Net, to do more than determine how wide someone‘s pipe would be - to control what they could do, and when," wrote Ars Technica‘s Net Neutrality activist Nate Anderson in a sentence that does much to encapsulate the paranoia of the campaign. The resurrection of Neutrality
The ruling is borne out of political pressure from a campaign funded by George Soros‘ Free Press, amongst others who cried foul at the actions of the US‘ biggest cable operator. Last autumn, Comcast found itself in an invidious position, one very few Reg readers would want to be in. Due to a bug in the cable modem protocol (DOCSIS), Comcast found that heavy BitTorrent users were crippling its network. BitTorrent doesn‘t respect the "honor box" of the internet, and it‘s not alone in not doing so. But the cable operator realised that BitTorrent users were all requesting bandwidth allocation on a per-packet basis at the same time. Because with the version of DOCSIS deployed by Comcast, all applications use the same slot for requesting bandwidth, and because BitTorrent requests bandwidth so aggressively (hundreds of times in a minute, compared to a few times an hour for an email application), the P2P app was effectively starving other applications of oxygen. (DSL modems don‘t have this particular technical gotcha - and next-generation cable modems based on DOCSIS 3.0 work around it.) So, for the most aggressive P2P users Comcast resorted to a crude workaround - but one much less crude than banning BitTorrent, or making downloads slower. At times of peak load, Comcast looked for BitTorrent seeders and threw away a few upload requests, for short periods of a few seconds. This let other network applications breath again, and BitTorrent performance increased overall. But campaigners, despairing of seeing their hobby horse die (Neutrality activism had peaked in 2006 with the tabling of two bills in Congress), saw their chance. Ignoring the fact that the P2P experience for humans at the end of the pipe (remember them?) was enhanced by the action, campaigners argued that Comcast was "busting" Torrents. It made for great headlines. Comcast‘s clunky technical fix was matched by even clunkier PR, with the cable company‘s flaks foolishly denying the network was engaged in traffic management. Given half a clue, Comcast last year should have argued that it‘s traffic management that "saves the internet" from collapsing in a heap. But Comcast has underestimated the ideological determination of its opponents, and campaigners‘ success in turning metaphors into engineering practices. Once unleashed, the mob began to imagine neutrality violations everywhere. Comcast has since renounced the practice and engaged in an effort to create a better P2P experience for the future. It debunked the "busting" arguments in this FCC filing (pdf). The landmark decision draws together two strands of policy - one old and specific to the US, and one new and widespread. I‘ve noted before how American politics are largely fought through symbolic gestures. Think of the bitter fights over the wording on the US currency, or inscriptions on public statues. The Neutrality campaign was similarly engaged in a symbolic battle. But the other aspect is more disturbing. Britain‘s equivalent of the FCC, Ofcom, prides itself on what it calls "evidence-based policy making". It may not always succeed, but it‘s a tradition based on empiricism. With "Net Neutrality", what we‘re seeing is the opposite, where the direction is set on a hunch or intuition, or the angst of a mob, and the facts cherry-picked to support the conclusion. The definition of harm and "busting" are great illustrations. Call it "policy-based evidence-making", if you like. The ruling is expected shortly. |

I‘m so tempted to really, seriously critique this moie . . . not to discourage d.l.ing it but mostly because it fell SO short of everything I expected.
